MEDIATION EXPERTISE 

Koorosh Afshari is a highly skilled mediator who has handled hundreds of private disputes, resolving the great majority of them.

Afshari is married to Sabrine Rodems, a star winemaker at www.scratchwines.com where she makes limited production Pinot Noir, Grenache and Riesling. 


LAW BACKGROUND

Before becoming a full-time mediator, Afshari practiced state and federal law for a decade and half, including, at the venerable San Francisco law firms of Cartwright, Slobodin, Bokelman, Borowsky, Wartnick, Moore & Harris (IP, PI, Products, Medical & Legal Malpractice, Employment & Business
Litigation), and Owen, Wickersham & Erickson (Trademark, Patent, Copyright, Internet & Trade Secrets Litigation) serving clients ranging from injured individuals to large corporations, resulting in several published opinions.  See, e.g., Earthquake Sound Corp. v. Bumper Industries, Inc., 69 U.S.P.Q.2d 1119 (9th Cir. 2003) (Affirmed $200,000-plus in attorneys' fees for willful infringement); Machine Head v. Dewey Global Holdings, 61 U.S.P.Q2d 1313 (N.D. CA 2002) (Summary judgment of non-confusion; misdirected emails alone, insufficient evidence of actual confusion).

From 2003 to 2006, Afshari Law Firm served clients of various sizes, including The Men's Wearhouse, FUBU, and several  wineries, in trademark, unfair competition, and copyright matters.

Afshari's

ENGAGEMENT POLICY

1. Fees:

Half-Day (Up to 4 hours including preparation):

Two Sides: $1700  ($850/side)
Three Sides or More:  $1950  (Divided Equally; e.g., $650/side in three-sided case)

Full-Day (Up to 8 hours including preparation):

Two Sides: $3400  ($1700/side)
Three Sides or More:  $3900  (Divided Equally, e.g., $1300/side in three-sided case.)



2.  Cancellation/Postponement: 
It is understood that events, including settlement, may require the cancellation/postponement of a session.

However,

There is a $1700/$1950 or $3400/$3900 (Half/Full-Day) Cancellation/Postponement Fee for any cancellation/postponement within 15 calendar days prior to the session unless the time is filled;  the canceling/postponing party is responsible for the Cancellation/Postponement Fee; if counsel cannot agree who caused the cancellation or postponement, all parties are responsible on a pro rata basis.
    

Suggestion:  If the case is being settled/cancelled, during the 15-day period, consider negotiating who will pay the Cancellation/Postponement Fee; otherwise the fee is divided equally.


3.  Hard copies of all briefs are due one week before the session; additional e-mailed courtesy copies are greatly appreciated; please indicate whether briefs are confidential or not.

4.  Counsel/parties are jointly/severally responsible for
all charges; all charges beyond the minimum deposit are due received no later than 15 days after the session.

.  Counsel are encouraged to bring to the session a lap-top computer and/or settlement/release forms.
